Background Screening and the Legalization of Marijuana

Current election results now show that 4 more states have passed the legalization of marijuana for recreational use. States that now allow adult citizens to smoke weed include Colorado, Alaska, Oregon, Washington, California, Maine, Massachusetts and Nevada. Other states passed new laws allowing marijuana for medical use. In total, there are 25 states, plus Washington D.C., that allow the use of marijuana in some way. See the full list below.

Drug Screening FAQ for Human Resources Professionals

Every year, the drug screening laboratory diagnostics company Quest Diagnostics publishes its annual Drug Testing Index as a public service to reveal patterns of drug use among those in the American workforce. The company performs pre-employment screens as well as random drug testing among those already employed. With over 9.1 million tests on record, and after a large drop in positive tests from 1988 to 2012, the past few years are seeing a rise in positive drug tests for marijuana, cocaine, and methamphetamine. Are Random Drug Screenings a Good Idea?

While in Colorado at a recent conference, my colleague and I were riding in a taxi cab after a late dinner. Out of the blue, the taxi driver offered to take us somewhere to purchase marijuana. Even more shocking than that, he said he would smoke it with us if we decided to buy it. 

This scenario left us shaking our heads but also spurred this great blog topic. Because marijuana is legal in Colorado, can this taxi driver be randomly tested for drugs?

What Employers need to know about the legalization of Marijuana in Colorado

As of January 2014, Amendment 64 to the constitution of the State of Colorado went into effect. The amendment makes it legal for people over the age of 21 to use and possess up to one ounce of marijuana. Retail stores have begun to legally sell marijuana in that state.
